1. Acceptance of Terms

By accessing or using CaseEye ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms form a legally binding agreement between you (the "User") and CaseEye ("we", "us", or "our"), a service operated in the United Kingdom.

2. Description of Service

CaseEye is a case management platform designed for investigators, legal professionals, and businesses. The Service allows users to create and manage cases, upload evidence, track tasks and appointments, and store contact information.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

3. User Accounts

To use the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account credentials
  • Notify us promptly of any unauthorised use of your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account. Accounts registered on behalf of a business entity must be authorised by that entity.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Use the Service for any unlawful, fraudulent, or harmful purpose
  • Upload content that infringes the intellectual property rights of any third party
  • Upload content that is defamatory, obscene, or otherwise objectionable
  • Attempt to gain unauthorised access to other users' data or accounts
  • Interfere with or disrupt the operation of the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the Service

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Data and Content Uploads

You retain ownership of all content, including case data, notes, and evidence files, that you upload to the Service. By uploading content, you grant us a limited, non-exclusive licence to store and process that content solely to provide the Service to you.

You are solely responsible for ensuring that content you upload:

  • Does not violate any applicable laws or regulations
  • Does not infringe the rights of any third parties
  • Is accurate and lawfully obtained

We do not access or review your case content except where required by law, to investigate a reported violation of these Terms, or to provide technical support with your consent.

6. Subscription and Payments

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly basis. All prices are listed on our Pricing page.

Payments are processed securely by our payment provider. We do not store your payment card details on our servers.

Subscriptions may be cancelled at any time. Upon cancellation, access to paid features will continue until the end of the current billing period. We do not offer partial refunds for unused periods unless required by applicable law.

7. Intellectual Property

All rights in the CaseEye platform, including its design, software, and documentation, are owned by us or our licensors. Nothing in these Terms transfers any intellectual property rights to you.

You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that data stored will not be lost.

To the maximum extent permitted by applicable law, we exclude all liability for any indirect, incidental, or consequential loss arising from your use of the Service.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

10. Termination

We may terminate or suspend your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

You may close your account at any time from your account settings. On closure, we will delete your data in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
